RULES OF THE COMPETITION "Win valuable prizes from Dyson"

These rules ("rules") contain the complete terms and conditions of the consumer competition called "Win valuable prizes from Dyson" ("competition"). These rules are available continuously throughout the duration of the competition at the internet address https://www.rohlik.click/tema/coca-cola-christmas and constitute the only binding document in relation to consumers governing the rules of the competition. These rules may only be amended in the form of written addenda to this document published in the same way as this document. Extracts from these rules or an abbreviated version of these rules presented in advertising and promotional materials are for informational purposes only and are not legally binding rules of this competition.

 

COMPETITION ORGANISER

The organiser of the competition is the company VELKÁ PECKA s.r.o., with its registered office at Sokolovská 100/94, Karlín, 186 00 Prague 8, ID No.: 030 24 130, registered in the Commercial Register maintained by the Municipal Court in Prague under file no. C 226550 ("organiser"), operator of the e-shop rohlik.click.

 

COMPETITION PROMOTER

The promoter of the competition is the company Coca‑Cola HBC Česko a Slovensko, s.r.o., Českobrodská 1329, 19821 Prague 9 - Kyje; ID No.: 41189698, VAT No.: CZ41189698 (hereinafter referred to as the "promoter").

 

PLACE AND TIME OF THE COMPETITION

The competition will take place in the territory of the Czech Republic at the internet address www.rohlik.click ("competition website") within the following competition period ("competition period"):

 

from 1 December 2025 00:00:00 to 14 December 2025 23:59:59 ("competition period")

 

The decisive moment for assessing whether a contestant has met the conditions for inclusion in the competition in the given competition period is the moment of sending a binding order of goods placed through the e-shop rohlik.click, which was subsequently (i.e. even after the expiry of the competition period) not returned by the customer (either as a whole or even partially, if this would result in a drop in the value of the minimum required amount of orders necessary for participation in the competition), or for which the buyer did not withdraw from the purchase contract. For the avoidance of doubt, it is established that the application of a justified claim for goods does not reduce the value of the order for the purpose of participation in the competition.

 

COMPETITION PARTICIPANTS

A participant in the competition can be any natural person over 18 years of age who has a user account in their name on the e-shop rohlik.click and who meets the conditions of participation in the competition set by these rules ("contestant"). With regard to the possibility of purchasing goods on the e-shop rohlik.click only after prior registration, one user account maintained on the e-shop rohlik.click is considered as one contestant.

 

All contestants who do not properly meet the conditions of participation in the competition in accordance with these rules during the competition period will be excluded from the competition. Furthermore, all persons in an employment or similar relationship to the organiser or promoter, persons personally and financially linked to the organiser or promoter, or who are close persons to such persons within the meaning of Section 22(1) of Act No. 89/2012 Coll., the Civil Code, as amended, are excluded from participation in the competition. In the event that such an excluded person becomes a winner, the prize will not be handed over to them and will be forfeited to the organiser.

 

The organiser reserves the right to exclude from the competition those contestants whose competition behavior shows signs of fraudulent competition or if there is other reasonable suspicion of abuse of the competition or bypassing of these rules in violation of the rules of this competition or the purpose of the competition. The organiser reserves the right at any time, at its discretion, to assess the fulfillment of the set conditions of the competition by individual contestants and to exclude contestants who do not meet the conditions specified in these rules from the competition at its discretion.

 

PRIZES

The following number of prizes are placed in the competition:

 

Main prize: 1x Dyson V12™ Detect Slim Absolute / Dyson. Runner-up prize: 2x Dyson Supersonic hair dryer HD07 T3/T4 Prussian blue/copper / DATART, 5x (1000 CZK) voucher Potten Pannen.

 

 

HOW TO VALIDLY PARTICIPATE IN THE COMPETITION?

Participation in the competition is conditional on placing orders for goods on the e-shop rohlik.click ("competition purchases"), provided that for inclusion in the competition it is necessary to purchase Coca-Cola products (Coca-Cola Original, Coca-Cola Zero, Fanta or Sprite) with a minimum value of 159 CZK within one online order in the online store Rohlík.cz during the competition period.

 

In the event that the contestant adds goods to the order within one order, even before the actual delivery of this order, the final amount spent on one completed and actually delivered purchase, including all additional orders, is decisive for the order amount.

 

Registration for the competition takes place automatically by fulfilling the above conditions for participation in the competition (i.e. by binding order, payment and receipt of competition purchases). Every contestant who meets the conditions of participation in the competition set by these rules will be automatically included in the prize draw; however, they are not obliged to take any action or otherwise actively participate in the competition in the event of winning.

 

Each contestant can be included in the draw only once in each of the competition periods. In the event of a contestant winning in the first competition period, that contestant will not be included in the draw in the second competition period (i.e. one contestant can win in the competition at most once). If a contestant who already has one prize is drawn, the second drawn prize is disregarded and a new contestant is drawn for it.

The draw will take place within 7 calendar days after the end of each competition period. The drawing of winners will take place through a random number generator. In the event that an insufficient number of contestants participate in the competition or an insufficient number of contestants meet the conditions for obtaining prizes (and some or all of the prizes placed in the competition cannot be awarded), or if one of the winners refuses to accept the prize, the undistributed prizes are forfeited in favor of the organiser, who is entitled to decide on their further use.

 

ANNOUNCEMENT OF WINNERS

The announcement of the winners of individual prizes takes place within 7 calendar days from the end of each competition period. In the event of winning, the winner will be contacted by e-mail to the e-mail associated with their user account on the e-shop rohlik.click and at the same time by calling and/or sending an SMS message to the phone number that the contestant specified in their user account on the e-shop rohlik.click. By participating in the competition, the contestant acknowledges that their e-mail and phone number registered on the e-shop rohlik.click will be used to communicate the win in the competition. The organiser is not responsible for entering an incorrect e-mail or phone number or other errors within the contestant's user account.

 

According to the organiser's decision, the prize in the competition may also be handed over to the winner in person, or a personal meeting of the organiser with the winner may take place, at a time and place communicated to them by the organiser, unless the organiser agrees otherwise with the winner.

 

The organiser reserves the right to change the rules of this competition at any time, or to limit, postpone or interrupt its implementation, including its validity period, or to terminate the competition, throughout the entire competition period. Such fact will be immediately announced to the contestants on the competition website. The organiser is entitled to check the fulfillment of all conditions for participation in the competition and, in the event of a dispute, to decide with final validity on any issue related to the competition. The contestant is obliged to send any objections to the course of the competition to the organiser within 5 working days from the end of the given competition period in writing to the address of the organiser's registered office. Later objections will not be taken into account. The organiser is not responsible for any damage caused to the winners (contestants) or third parties in connection with participation in the competition or the realization of prizes.

 

PERSONAL DATA PROTECTION

By participating in the competition, the contestant acknowledges that for the purposes of organizing the competition, it is necessary to process personal data in the scope of: first name and surname, telephone, e-mail address and information about the competition purchase.

 

The contestant further acknowledges that the company VELKÁ PECKA s.r.o., with its registered office at Sokolovská 100/94, Karlín, 186 00 Prague 8, ID No.: 03024130, is, as the personal data controller, entitled to process their personal data in the scope specified above, or other data communicated to the organiser, for the purposes of participation in the competition (Article 6(1)(b) of Regulation (EU) 2016/679 of the European Parliament and of the Council), which purpose includes in particular the following processing operations:

  • storing personal data for registration in the competition;

  • sending informative e-mails, or contacting contestants through calls or SMS in matters concerning the organization and management of the competition;

  • processing personal data for the purposes of checking and evaluating the competition according to the rules;

  • personal, telephone, written and electronic contact for the purpose of verifying the fulfillment of the competition conditions by the contestant, information about the win and other related communication.

Personal data will be processed automatically and securely in electronic form, for the period necessary for organizing the competition, checking the fulfillment of the competition conditions and potential inspection by public authorities, for a maximum of 3 years from the end of the competition, unless the law stipulates a longer period.

 

The promoter is the processor of the organiser in relation to the personal data of the contestants.

 

As a data subject, the contestant has the rights listed below, which arise for them from legal regulations, and which they can exercise at any time. This is the right (i) to access personal data, (ii) to correct inaccurate or false personal data and supplement incomplete personal data, (iii) to delete personal data if the personal data are no longer needed for the purposes for which they were collected or otherwise processed, or if it is found that they were processed unlawfully, (iv) to restrict the processing of personal data, (v) to data portability and (vi) the right to object, after which the processing of the contestant's personal data will be terminated, unless it is proven that there are serious legitimate reasons for processing that outweigh the interests or rights and freedoms of the contestant, in particular if the reason is the potential enforcement of legal claims. At the same time, the contestant has the opportunity to file a complaint with the supervisory authority, which in the Czech Republic is the Office for Personal Data Protection (www.uoou.cz).

 

To exercise their rights, file a complaint or in case of any question, the contestant can contact the controller by e-mail sent to the address: privacy@rohlikgroup.com or zakaznici@rohlik.click.

  

Based on legitimate interest, the organiser is entitled to distribute the name, first letter of the surname and city of residence of the winner in the competition free of charge. In the event of a personal meeting of the organiser with the winner or the presentation of the prize, the organiser is also entitled to capture, display, reproduce and distribute the appearance, likeness, images and video and audio recordings concerning the winner free of charge, including their processing and inclusion in an audiovisual work, on the competition website or social networks of the organiser, for the duration of the competition and further for a period of 1 week from the end of the competition period. The contestant may object to this processing.

 

INCOME TAX FROM THE COMPETITION

By participating in the competition, the contestant acknowledges that only prizes up to a value of 10,000 CZK (incl. VAT) are exempt from personal income tax. In the event that the value of the prize exceeds 10,000 CZK (incl. VAT), the prize is subject to taxation in accordance with Section 36(2)(i) of Act No. 586/1992 Coll., on Income Taxes, as amended, and it is necessary to pay tax collected by withholding at a special tax rate (so-called withholding tax). The withholding tax on the prize will be paid by the competition organiser in accordance with legal regulations.

 

FINAL PROVISIONS

By participating in the competition, the contestant accepts without reservation that the competition is organized and run according to Czech law and that any disputes related to the competition will be resolved exclusively before the courts of the Czech Republic.

 

Payment of monetary performance instead of the prize is not possible and the contestant is not entitled to demand the exchange of the prize.

 

Unless the organiser or these rules determine otherwise, all announcements about the competition, its course and changes will be made through the competition website.

 

The organiser is not responsible for the temporary unavailability of the competition website caused by objective circumstances, in particular a defect in the internet connection or other technical failure.

 

The body authorized for out-of-court settlement of consumer disputes arising in connection with the participation of a contestant who is a natural person – consumer, in this competition is the Czech Trade Inspection Authority, on whose website (www.coi.cz) the contestant will find, among other things, information on the method and conditions of out-of-court dispute resolution, when this procedure can be initiated only on the basis of the contestant's proposal and after they fail to resolve the dispute directly with the organiser. The proposal form for initiating the procedure for out-of-court settlement of consumer disputes is available on the website of the Czech Trade Inspection Authority.

 

A contestant who is a natural person – consumer, also has the right to initiate an out-of-court dispute resolution online through the ODR platform available on the website https://webgate.ec.europa.eu/odr/main/index.cfm?event=main.home.show&lng=CS. The out-of-court dispute resolution procedure is not mediation according to Act No. 202/2012 Coll., on Mediation, nor arbitration proceedings according to Act No. 216/1994 Coll., on Arbitration Proceedings and Enforcement of Arbitral Awards, as amended, and its use does not affect the contestant's right to turn to the Czech Trade Inspection Authority or the court with their claim.
