COMPETITION RULES
These rules ("rules") contain the complete regulation of the terms and conditions of the contest titled "Contest for Festival Passes to the 56th Karlovy Vary International Film Festival on rohlik.click" ("contest"). These rules are continuously available throughout the duration of the contest at the internet address www.rohlik.click/tema/soutez-o-akreditace-kviff and constitute the sole binding document in relation to consumers governing the rules of the contest. These rules may only be amended by written addenda to this document published in the same manner as this document. Excerpts from these rules or a shortened version of these rules presented in advertising and promotional materials are for informational purposes only and are not legally binding rules of this contest.
CONTEST ORGANIZER
The organizer of the contest is the company VELKÁ PECKA s.r.o., with its registered office at Sokolovská 100/94, Karlín, 186 00 Prague 8, ID No.: 030 24 130, registered in the Commercial Register maintained by the Municipal Court in Prague under file no. C 226550 ("organizer"), operator of the rohlik.click e-shop.
PLACE AND DURATION OF THE CONTEST
The contest will take place from June 10, 2022, 10:01:00 AM to June 28, 11:59:59 PM in the territory of the Czech Republic at www.rohlik.click ("contest page") ("contest duration" and "contest location").
CONTEST PARTICIPANTS
Any natural person over 15 years of age who meets the conditions for participation in the contest set out in these rules may be a participant in the contest ("contestant").
All contestants who do not properly fulfill the conditions for participation in the contest in accordance with these rules during the contest duration will be excluded from the contest. Furthermore, all persons in an employment or similar relationship with the organizer, persons personally and financially connected with the organizer, or who are in a close relationship with such persons within the meaning of Section 22, paragraph 1 of Act No. 89/2012 Coll., Civil Code, as amended, are excluded from participation in the contest. In the event that such an excluded person becomes a winner, the prize will not be handed over to them and will be forfeited to the organizer.
The organizer reserves the right to exclude from the contest those contestants whose contest behavior shows signs of fraudulent contesting or for whom there is other reasonable suspicion of abusing the contest or circumventing these rules in violation of the rules of this contest or the purpose of the contest. The organizer reserves the right to assess, at any time at its discretion, the fulfillment of the established contest conditions by individual contestants and to exclude from the contest, at its discretion, contestants who do not meet the conditions stated in these rules.
CONTEST MECHANICS, EVALUATION, AND PRIZES
The following conditions are set for participation in the contest:
The contestant enters the contest by making 3 purchases on the contest page during the contest duration, each with a minimum value of 1,000 CZK.
Registration for the contest takes place automatically upon fulfillment of the above conditions for participation in the contest (i.e., making 3 purchases on the contest page with a minimum value of 1,000 CZK). Each contestant who meets the conditions for participation in the contest set out in these rules will be automatically entered into the prize draw; however, they are not obliged to take any action or otherwise actively participate in the contest in the event of a win.
The prizes in the contest are
4× two (2) Festival Passes for the entire duration of the 56th KVIFF Carlsbad, valued at 3,000 CZK, which takes place from July 1, 2022, to July 9, 2022 ("prize").
The organizer will draw a total of four (4) contestants from those who meet the conditions stated in these rules, who will each receive one (1) prize ("winner").
The draw will take place within 2 calendar days after the end of the contest duration, with the participation of the organizer's representatives. Each contestant can win only one (1) prize. The drawing of winners will be conducted using a random number generator.
In the event that an insufficient number of contestants participate in the contest or an insufficient number of contestants meet the conditions for winning prizes (and some or all prizes entered into the contest cannot be awarded), or if any of the winners refuse to accept the prize, the undistributed prizes will be forfeited to the organizer, who is entitled to decide on their further use.
ANNOUNCEMENT OF WINNERS
The winner will be informed at the relevant email address to which their user account on rohlik.click is registered ("notification"), on the day of the draw. Other contestants will not be notified.
Prizes in the contest will be ready for collection by the winners in the Rohlik zone directly in Carlsbad in Smetanovy Sady from Friday, July 1, 2022. In the event of prize collection by a person other than the winner, such person is obliged to prove their identification data including first name and surname, date of birth, and place of residence, which the winner is obliged to communicate to the organizer in advance.
The organizer reserves the right to change the rules of this contest at any time, or to limit, postpone or suspend its implementation, including its validity period, or to terminate the contest, throughout the entire contest period. Such fact will be immediately announced to the contestants on the contest pages. The organizer is entitled to check the fulfillment of all conditions for participation in the contest and, in case of dispute, to decide with final validity on any matter related to the contest. Any objections to the course of the contest must be sent by the contestant to the organizer within 5 working days from the end of the given contest period in writing to the organizer's registered office address. Later objections will not be considered. The organizer is not liable for any damages incurred by the winners (contestants) or third parties in connection with participation in the contest or the realization of prizes.
PERSONAL DATA PROTECTION
By participating in the contest, the contestant acknowledges that for the purpose of organizing the contest, it is necessary to process personal data to the extent of: first name and surname, telephone number, and email address to which the user account on rohlik.click is registered.
The contestant further acknowledges that the company VELKÁ PECKA s.r.o., with its registered office at Sokolovská 100/94, Karlín, 186 00 Prague 8, ID No.: 03024130, as the personal data controller, is authorized to process their personal data to the extent specified above, or other data communicated to the organizer, for the purpose of participation in the contest (Article 6, paragraph 1, letter b) of Regulation (EU) 2016/679 of the European Parliament and of the Council), whereby this purpose includes, in particular, the following processing operations:
– storage of personal data for registration in the contest;
– sending informative emails, or contacting contestants via calls or SMS regarding the organization and conduct of the contest;
– processing of personal data for the purpose of checking and evaluating the contest according to the rules;
– personal, telephone, written, and electronic contact for the purpose of verifying the contestant's fulfillment of the contest conditions, information about the win, and other related communication.
Personal data will be processed automatically and securely in electronic form, for the period necessary for organizing the contest, checking the fulfillment of contest conditions, and possible inspection by public authorities, for a maximum of 3 years from the end of the contest, unless the law stipulates a longer period.
As a data subject, the contestant has the rights listed below, which arise for them from legal regulations and which they can exercise at any time. These include the right (i) to access personal data, (ii) to rectify inaccurate or false personal data and to complete incomplete personal data, (iii) to erase personal data if the personal data are no longer necessary for the purposes for which they were collected or otherwise processed, or if it is found that they were processed unlawfully, (iv) to restrict the processing of personal data, (v) to data portability, and (vi) the right to object, after which the processing of the contestant's personal data will be terminated, unless it is demonstrated that there are serious legitimate reasons for processing that outweigh the interests or rights and freedoms of the contestant, especially if the reason is the possible enforcement of legal claims. At the same time, the contestant has the option to file a complaint with the supervisory authority, which in the Czech Republic is the Office for Personal Data Protection (www.uoou.cz).
To exercise their rights, file a complaint, or in case of any questions, the contestant can contact the controller by email sent to: privacy@rohlikgroup.com or zakaznici@rohlik.click.
By participating in the contest, the contestant gives consent for the organizer, especially in connection with a possible win, to freely disseminate the contestant's first name, first letter of surname, and city of residence, in the media, on the internet, or in the organizer's promotional materials. In the event of a personal meeting between the organizer and the winner or the handover of the prize, the organizer is also authorized to freely capture, display, reproduce, and distribute the likeness, portrait, image recordings, and audio-visual recordings concerning the winner, including their processing and inclusion in an audiovisual work, on the contest pages or the organizer's social networks, for the duration of the contest and for one (1) year from the end of the contest duration. The contestant may object to this processing.
FINAL PROVISIONS
By participating in the contest, the contestant unreservedly accepts that the contest is organized and conducted under Czech law and that any disputes related to the contest will be resolved exclusively before the courts of the Czech Republic.
Payment of monetary compensation instead of the prize is not possible, and the contestant is not entitled to demand an exchange of the prize.
Unless otherwise specified by the organizer or these rules, all announcements about the contest, its course, and changes will be made through the contest pages.
The organizer is not responsible for the temporary unavailability of the contest pages caused by objective circumstances, especially a defect in the internet connection or other technical outage.
The body authorized for out-of-court resolution of consumer disputes arising in connection with the participation of a contestant who is a natural person – consumer, in this contest is the Czech Trade Inspection Authority, on whose website (www.coi.cz) the contestant will find, among other things, information about the method and conditions of out-of-court dispute resolution, when this procedure can only be initiated on the basis of a proposal by the contestant and after they fail to resolve the dispute directly with the organizer. The form for initiating out-of-court consumer dispute resolution is available on the website of the Czech Trade Inspection Authority.
A contestant who is a natural person – consumer also has the right to initiate out-of-court dispute resolution online through the ODR platform available on the website https://webgate.ec.europa.eu/odr/main/index.cfm?event=main.home.show&lng=CS. The out-of-court dispute resolution procedure is not mediation according to Act No. 202/2012 Coll., on Mediation, nor arbitration proceedings according to Act No. 216/1994 Coll., on Arbitration Proceedings and Enforcement of Arbitral Awards, as amended, and its use does not affect the contestant's right to turn to the Czech Trade Inspection Authority or a court with their claim.
